			<content:encoded><![CDATA[<p>When people think of jobs that could be dangerous, tow truck driver is usually relatively low on the list, if it appears at all.  However, stopping along busy roads to tow a vehicle can be dangerous, especially when someone on the road has been drinking and is beyond the point of being able to legally drive.  Tragically, this is the scenario that played out and led to the death of a tow truck driver Sunday in Virginia.</p>
<p>According to <a href="http://www.wivb.com/dpp/news/nation/south/nat_wavy_virginia_tow_truck_driver_killed_while_working_200908101011_2746096">WIVB</a>:</p>
<p>&#8220;WAVY.com was at the scene Sunday night on I-64. Police say 51-year-old William Burns of Newport News was drunk when he lost control of his 2005 Mitsubishi Raider truck and smashed into the back of Starmer&#8217;s tow truck.</p>
<p>In the direct path of the out of control vehicle stood Starmer. He was hooking the last chain onto the broken down van. He never knew, moments before he lost his own life, he saved someone else&#8217;s.</p>
<p>&#8220;Him and the driver were standing (next to the tow truck) just mere seconds before (the crash) happened and he explained to the other driver, he said, &#8216;Look sir, I really need you to go back on the other side of the vehicle out of harms way because you never know what happens out here, okay?&#8217;&#8221; says Clarence Patrick of Superior Towing.&#8221;</p>

			<content:encoded><![CDATA[<p>Many auto accidents leave behind a wake of devastation, as people get injured and others are killed with alarming regularity.  However, it&#8217;s rare to see reports of fatalities that include twins that have yet to be born.  However, that&#8217;s exactly what happened in Vermont on Monday.  The pregnant woman was six months pregnant, and by all indications the twins were healthy and viable relative to their stage of development.</p>
<p>According to the <a href="http://www.timesargus.com/article/20090812/NEWS02/908120315/0/CUSTOMERCARE02">Times Argus</a>:</p>
<p>&#8220;Patricia Blair, 38, of Bennington, was driving south on Route 7 in a minivan when it was hit head-on by a car driven north by Kelly Cook, 22, of Pownal, according to Bennington Police Sgt. Lloyd Dean. Cook was cited for driving under the influence of a substance that affected her ability to drive although Dean said it was not alcohol.</p>
<p>The five people involved in the accident, four people in Blair&#8217;s minivan and Cook, who was alone in her 2003 Hyundai Sonata, were taken to Southwestern Vermont Medical Center in Bennington.</p>
<p>But Dean said that after emergency surgery and a Caesarean section, the twins died in the medical center.</p>
<p>Dean, who is the Bennington Police Department&#8217;s crash investigator, said police believe that Cook was driving faster than the speed limit at the time of the crash and drove left of the center line.&#8221;</p>

			<content:encoded><![CDATA[<p>We posted recently about a <a href="http://www.phillipsnationalinjurygroup.com/eight-people-killed-in-horrific-new-york-auto-accident/">tragic auto accident in New York</a> in which a woman appeared to drive the wrong way into oncoming traffic, causing the deaths of eight people, including four children.  Investigators and family members were similarly baffled as to what could lead someone to make such a decision, and now comes word that at least one factor has been identified - the driver was apparently drunk and high at the time of the accident.</p>
<p>According to <a href="http://abcnews.go.com/GMA/story?id=8249454&amp;page=1">ABC News</a>:</p>
<p>&#8220;Diane Schuler was drunk and high when she drove straight into oncoming traffic on a New York highway, swerving for nearly two miles to narrowly avoid crashes until she slammed head on into an SUV and took eight lives, including four children, investigators said today.</p>
<p>Schuler had a blood alcohol content of .19, more than double the legal limit and was also &#8220;impaired by marijuana,&#8221; according to a statement released by state attorney Janet Difiore citing a toxicology report by the Westchestery County medical examiner.</p>
<p>During the drive, Schuler called her brother to tell him she wasn&#8217;t feeling well. He asked her to pull over immediately. Schuler did not pull over, but her brother was worried enough to call the police.&#8221;</p>

			<content:encoded><![CDATA[<p>Many people have seen, heard or read reports of SUV&#8217;s and their troubling tendency to flip when they encounter sharp turns.  Several lawsuits have been filed for this sort of occurrence around the country.  Therefore, when you combine an SUV, high speeds and an allegedly drunk driver, it only spells disastrous trouble for anyone involved.  Tragically, a passenger in the SUV of a driver who is suspected of DUI paid the ultimate price for this set of circumstances recently in Indiana.</p>
<p>According to the <a href="http://www.indystar.com/article/20090707/NEWS02/907070382/Passenger+killed+in+SUV+rollover">Indianapolis Star-Tribune</a>:</p>
<p>&#8220;The passenger of a SUV was fatally injured in an early morning traffic accident on the Far Northside. The driver has been arrested for driving while intoxicated.  A Chevrolet Suburban was headed north in the 7900 block of Westfield Boulevard when the accident happened around 12:50 this morning, according to the Indianapolis Metropolitan Police Department. The driver lost control and the SUV rolled, ejecting the passenger. Knefler Jose, 18, 5800 block of North Pennsylvania Street, was declared dead at Methodist Hospital.</p>
<p>The driver, Maxwell J. Weerts, 18, 700 block of Nottingham Court, was not seriously injured. A police report said Weerts told investigators he swerved the SUV to avoid striking a deer.&#8221;</p>
<p>Clearly, the driver of the SUV faces serious legal consequences from prosecutors.  He could also face exposure to an enormous amount of civil liability for negligence and/or recklessness, and the issue of how the SUV rolled over is one that apparently has not yet been determined.</p>

<p>&#8220;American International Group Inc. and insurers at Lloyd’s of London are among firms that may face a combined total of more than $100 million in claims tied to the Washington Metro crash that killed nine people last month.</p>
<p>The costs to the pool of insurers, which also includes Bermuda-based XL Capital Ltd. and Warren Buffett’s Berkshire Hathaway Inc., will depend on estimates of medical care, loss of expected lifetime earnings and the degree of negligence by the Washington Metropolitan Area Transit Authority.</p>
<p>The cost “will easily exceed $100 million,” said Peter Grenier, a lawyer at Washington-based Bode &amp; Grenier LLP, who negotiated a $2.3 million settlement for a man who lost his wife when she was struck by a Metro bus in 2007.&#8221;</p>
<p>The costs assocaited with medical care, loss of lifetime earnings and the like are all closely tied to the form of damages that would be sought by passengers in lawsuits for negligence.  Therefore, when a disaster like this occurs, many insurers will simply look at the situation from a financial standpoint.  Basically, they will decide whether paying the claims as settlements to any lawsuits is less expensive than fighting the claims in court and potentially still having to pay the claims.</p>

			<content:encoded><![CDATA[<p>Summer is a time when millions of people take some time to have some fun, especially in parts of the United States where the climate only provides a relatively short amount of time for warm weather.  One of those areas is Wisconsin, and unfortunately, four people paid a tragic price for one person&#8217;s bad judgment over the first official weekend of summer.  A 53-year-old man was killed, along with three other people in another vehicle, when his car crashed head-on with theirs after driving the wrong way down a highway.  Authorities suspect alcohol was involved in the crash.</p>
<p>According to the <a href="http://www.greenbaypressgazette.com/article/20090620/GPG0101/906200600/Four-killed-in-U.S.-41-head-on-crash&amp;referrer=FRONTPAGECAROUSEL">Green Bay Press-Gazette</a>:</p>
<p>&#8220;Stephen Siebert, of Ashwaubenon, was driving a Jeep Liberty that hit a Chrysler Concorde, killing 20-year-old driver Paige Riley of Appleton and front-seat passenger Arielle Lewandowski, 17, Menasha. Samuel Goudy, 19, Neenah, who was sitting in the backseat of the Concorde, died later Friday.</p>
<p>Results of toxicology tests are not expected for 10 to 14 days, but authorities said they suspect alcohol played a role in the crash at 12:49 a.m. Friday.</p>
<p>Siebert, who was not wearing a seat belt, was thrown from the vehicle, which caught on fire, Brown County Medical Examiner Al Klimek said.</p>
<p>Siebert was involved in a separate traffic crash shortly before the fatal crash, the sheriff&#8217;s department said.&#8221;</p>

			<content:encoded><![CDATA[<p>When police officers put on their lights and sirens, other motorists are expected to yield the right of way and to basically steer clear of them.  This is not always possible, however, as police cruisers can hit speeds of 100 mph on city streets when it&#8217;s necessary to get to a potential crime scene.  Accidents in this context do occur, and there are times when the results are deadly.</p>
<p>This is particularly true when these pursuits occur late at night and in large cities, as the chances of crossing paths with a driver who may have had too much to drink only increase, thereby heightening the danger involved.  Tragically, that appears to have been the case on Wednesday night in Las Vegas, according to a report filed by <a href="http://www.kvbc.com/Global/story.asp?S=10320120&amp;nav=15MUUi4B">KVBC</a>:</p>
<p>&#8220;According to Metro, he and another officer in a separate patrol car were driving to a domestic violence call about 12:45 am. They were both rolling code, which means they were using lights and sirens. Manor was in the lead; the other officer watched as a red truck pulled directly into Manor&#8217;s path.<span><span style="color: #000000; font-size: x-small;">&#8220;Two minutes after they were en route, the second officer was on the radio calling in the crash,&#8221; says Sheriff Doug Gillespie. &#8220;This shows how quickly tragedy can strike. Many times going to the call is just as dangerous getting to the call.&#8221;</p>
<p>The man police say caused the accident is 45-year-old Calvin Darling. He was arrested on charges of felony DUI with death and failure to yield to an emergency vehicle.&#8221;</p>

<p><span style="font-size: 12pt; line-height: 115%; font-family: &quot;Times New Roman&quot;,&quot;serif&quot;;">The FDA has required Baxter to place a &#8216;black box&#8217; warning on all containers of Reglan products and has also ordered Baxter to perform a study that will determine whether or not the risks of keeping these products on the market outweigh the benefits. </span></p>

			<content:encoded><![CDATA[<p>King County Assessor Scott Noble has been involved in the criminal prosecution process since January after being involved in an auto accident that injured two women.  It was alleged that Noble was driving the wrong way on the freeway and that he collided head-on with the vehicle carrying the injured parties.  Originally, Noble pleaded not guilty to two counts of felony vehicular assault.</p>
<p>However, when Noble&#8217;s attorneys canceled a routine hearing recently, speculation started that he may ultimately plead guilty to either the charges currently in place or agree to a lesser charge after negotiating with prosecutors.  According to <a href="http://www.king5.com/localnews/stories/NW_041609WAB-noble-charges-KS.df13039b.html">Seattle King 5</a>:</p>
<p>&#8220;KING 5 News has learned that King County Assessor Scott Noble is expected to enter a guilty plea next month to charges he caused a DUI crash. <span class="vitstorybody">Two women were injured in the crash in January. Police say Noble struck them head-on while driving the wrong way on the freeway.</p>
<p>Noble was supposed to be in court today for a routine hearing. But the state attorney general&#8217;s office, which is prosecuting the case, tells KING 5 that the hearing was cancelled and a change of plea hearing set for May 14.&#8221;</p>

			<content:encoded><![CDATA[<p>Earlier this month Roger T. Linton, 41, was involved in  <a title="Car Accident" href="http://www.resource4personalinjury.com/topics/causesofpersonalinjury.html#car">car accident</a> that killed James J. Carey, 27.  Linton was charged with drunken driving and tuned himself in this past Wednesday.  When taken into custody, he was charged with criminal operating under the influence and leaving the scene of an accident.<br />
His bail was set to $25,000 for surety or $12,5000 in cash.  Officials expect that Linton would post bail on Wednesday.</p>
<p>He may face other charged after the investigation of the accident is complete.</p>
<p>It was around 7:00 pm on Oct. 7th that Carey was pronounced dead at the scene of the car accident.</p>
<p>Linton was driving a Chevrolet one-ton flatbed truck that was carrying stone that day.  He was found near his truck which was two miles away from where the accident occurred.  He tried to flee the scene but since his truck was damaged from the collision, he was only able to get two miles away before the engine died.<br />
Linton did not get <a title="injured" href="http://www.resource4personalinjury.com">injured</a> in the accident but was taken to a medical center for a blood alcohol test after police and their dogs sensed alcohol.  They also found empty containers of alcohol near the truck.  His BAC reading was .12 which is 50% above the state legal limit of .08.</p>
