On the heels of yesterday’s news that the FDA had issued a public warning to stop using Zicam, the company responsible for the product line’s presence on the market, Matrixx Initiatives, Inc., has responded. Today, the company announced that it was voluntarily recalling all products named in the original warning letter drafted and released by the FDA until the matter is resolved.

Zicam came under fire because the FDA had received at least 130 reports of consumers using the products in question and subsequently losing their sense of smell, which is known in the medical world as anosmia. To date, no duration of this condition has yet been defined by medical officials, although consumers have complained that they were not able to smell for several months at a time.

There were three products specifically mentioned as being linked to the development of this side effect:

Zicam Cold Remedy Nasal Gel (15mL, NDC 62750-003-10)

Zicam Cold Remedy Swabs (20 swabs, NDC 67250-003-20)

Zicam Cold Remedy Swabs, Kids Size (20 swabs, NDC 67250-003-21)

Officials believe that the problem is with one of the ingredients in these products, that being zinc. Zinc has been known to attack the nerves in the nasal passages in the past and create this problem for those who were exposed to it.

The FDA stated that it is possible for these products to find their way back onto the market, but only if they go through the typical FDA approval process like any other medication. Zicam did not have to complete this process when the products were originally released because they were classified as ‘homeopathic,’ thereby circumventing the FDA before being sold on an over-the-counter basis around the United States.

If you or someone you love has been injured as a result of using these products, contact the Phillips National Injury Group today to schedule a free initial consultation.

Zicam has been one of the highest-selling over-the-counter cold medications on the market in recent years, and its manufacturer, Matrixx Initiatives, has enjoyed a solid stock value as a result. However, that all changed today as the company received a letter from the US Food and Drug Administration ordering the company to stop marketing Zicam unless the company decides to apply for a drug approval with the FDA.

The reason for the letter and public warning is that the FDA has received at least 130 reports of consumers using Zicam products and suffering from a loss of the sense of smell. No duration of this sensory loss has yet been defined, but it’s believed that the ingredient responsible for the development of this side effect is zinc. Zinc has been linked to the loss of smell in several other contexts.

There were three specific products that came under FDA scrutiny:

Zicam Cold Remedy Nasal Gel (15mL, NDC 62750-003-10)

Zicam Cold Remedy Swabs (20 swabs, NDC 67250-003-20)

Zicam Cold Remedy Swabs, Kids Size (20 swabs, NDC 67250-003-21)

Matrixx Initiatives issued a response on its Web site, that says in part:

“Based on the FDA’s action, the company has suspended shipments of these products and will reimburse any customer desiring a refund. However, the company believes the cumulative body of independent scientific and medical evidence supports both the safety and efficacy of Zicam intranasal cold remedy products. Matrixx Initiatives stands behind the science of its products and its belief that there is no causal link between its intranasal gel products and anosmia. (Ed’s note: Anosmia is the medical term for the loss of smell) For this reason, Matrixx Initiatives believes that the FDA action is unwarranted and will seek a meeting with the FDA to review the company’s product safety data.”

Whether Matrixx Initiatives is correct in its assertions is a matter for another time. In the meantime, follow the advice of the FDA and stop using these products. If you have been injured as a result of using Zicam products, contact the defective products lawyers at the Phillips National Injury Group as soon as possible to schedule a free initial consultation.

There have been statements, claims, lawsuits and general complaints in regard to the defective Chinese drywall issue in Florida and the southeatern United States. Now comes word that the US Senate is getting involved, as it announced that hearings will be held on this matter next week. Florida Senator Bill Nelson, who has been outspoken in regards to this issue, sits on the sub-committee that will run the hearings.

According to the Herald Tribune of Sarasota:

“Nelson, along with Sen. Mary Landrieu, D-La., has introduced legislation calling for immediate testing to determine the effects of the drywall and for a recall of the tainted material to be issued by the CPSC.

Both senators, along with Rep. Robert Wexler on the House side, have also asked Congress to include $2 million in emergency funding for expedited testing.

The potential scope of the Chinese drywall problem could be huge. A Feb. 1 Herald-Tribune analysis of shipping records found that more than 550 million pounds of Chinese drywall entered the country through more than a dozen U.S. ports since 2006, enough to build 60,000 average-sized homes.

At least two American drywall manufacturers are also in disputes with Florida homeowners about corrosion and odors in their homes, which contain only domestic wallboard. Both domestic producers, Charlotte, N.C.-based National Gypsum and Atlanta-based Georgia-Pacific, have denied their products are to blame.”

It isn’t unheard of that problems like these arise, the Senate gets involved, people become more aware of the issue and the scope of the issue grows as a result. If you have been harmed by defective Chinese drywall, contact the defective products attorneys at the Phillips National Injury Group today to schedule a free initial consultation.

Millions of people suffer from gastrointestinal problems of some sort, and they are all painful, uncomfortable and inconvenient, especially if the problem with the GI tract involves lack of bowel control or irritable bowel syndrome (IBS). There are several products on the market these days to help consumers deal with these problems, and for a time one of the most prevalent was Reglan, which is manufactured by Baxter Pharmaceuticals.

Reglan is also sold under several different brand names, including:

Hydroxycut is a widely-known line of dietary supplements that have been for sale on an over-the-counter basis for several years in the United States. These products have generally sold well, and estimates indicate that more than 9 million containers of Hydroxycut containers have been sold in the past year.

The products work by raising the body’s temperature and thereby burning calories. They have been used prominently by those who are overweight and want to trim pounds and by body builders who want to burn fat while maintaining lean muscle mass, which the Hydroxycut products claim to do.

However, now comes word that 14 of these products have been recalled on the heels of scrutiny from the US Food and Drug Administration (FDA), and that recall has been issued in conjunction with a statement from the FDA that people should stop using these products immediately.

Specifically, the reason for the recall is that at least 23 reports of serious and danerous side effects have arisen from consumers who have used these products, and these side effects seem to be centered on the liver. One person has died from using these products and others have suffered irreversible liver damage.

The following products are subject to the immediate recall:

The two older children were taken to the hospital and are in stable condition.

Police stated that no one in the car was wearing seatbelts.

After Halloween Spc. Joseph D. Binion, 23, was walking home when he was hit and killed by a truck in El Paso, Texas around 2:30 am.

Police reported that David Palacios was driving the blue Chevrolet Silverado truck that hit Binion. After he hit the Chicago soldier, he fled from the scene. Special traffic investigators caught up to Palacios and arrested him. Police stated that Palacios was taken into custody and charged with intoxicated manslaughter and an accident causing personal injury or death.

The death of Binion hit the town harder since he was a soldier. One person said that she thought “it’s terrible that a soldier, who can go across the country or halfway around the world, serves his country and comes home and is killed by some crazy driver not paying attention.”

Local officials warn that during holidays like Halloween both pedestrians and drivers have to be even more careful. During the night of this accident, there were many children also crossing the street. Some had dark clothing on too.

Local police reported that there has been a little increase in car accidents. 52 people have been killed in car accidents where last year at this same time there had been 46.

Police were called to the first accident around 9 pm last week. This accident caused traffic to stop on the highway. Just a half hour later, a semi truck approaching the accident didn’t slow down enough which caused him to crash into multiple vehicles.

This collision occurred just two miles south of the first crash. The second crashed involved several vehicles, three of which were semi trucks and four were passenger vehicles. One of the passenger vehicles was pulling a trailer. Ten were taken to local hospitals by ambulance and helicopter with inuries. A few of them are in critical condition.

Witnesses say that it was a chain reaction accident. Considering how many cars were involved, the scene was quite calm after the crash. Rescue workers had to free victims from their trapped cars. One car was trapped underneath one of the semi trucks.

One of the semi trucks was from the Target store. The back door of its trailer was ripped off but the trailer itself was empty.

Since there were so many victims and vehicles involved in the accident, there is an investigation still in progress. Police have not released the names of any of the victims.
