Earlier this month Roger T. Linton, 41, was involved in car accident that killed James J. Carey, 27. Linton was charged with drunken driving and tuned himself in this past Wednesday. When taken into custody, he was charged with criminal operating under the influence and leaving the scene of an accident.
His bail was set to $25,000 for surety or $12,5000 in cash. Officials expect that Linton would post bail on Wednesday.
He may face other charged after the investigation of the accident is complete.
It was around 7:00 pm on Oct. 7th that Carey was pronounced dead at the scene of the car accident.
Linton was driving a Chevrolet one-ton flatbed truck that was carrying stone that day. He was found near his truck which was two miles away from where the accident occurred. He tried to flee the scene but since his truck was damaged from the collision, he was only able to get two miles away before the engine died.
Linton did not get injured in the accident but was taken to a medical center for a blood alcohol test after police and their dogs sensed alcohol/ They also found empty containers of alcohol near the truck. His BAC reading was .12 which is 50% above the state legal limit of .08.
