Problems Arise in Construction Zone in Texas

Road construction is a reality that every driver must deal with around the country, especially during the warm-weather months.  Unfortunately, these construction zones can be dangerous, especially when they are near high-traffic areas and interstate highways.  One such construction zone in Texas has been the scene of more than one serious auto accident, and an accident that led to two deaths is the subject of a lawsuit filed against several parties.

According to the Fort Worth Star-Telegram:

“The wrongful-death lawsuit was filed Wednesday in Gainesville for Melissa Hinkle of Benbrook, according to a news release from her lawyer, Steve Laird of Fort Worth.

Her father, Gervious Hinkle, 63, of Fort Worth and her 13-year-old son, Casey, died from injuries in a crash involving their sport utility vehicle and a tractor-trailer on a stretch of Interstate 35 that was undergoing repairs six miles south of Gainesville.

Defendants include the Texas Department of Transportation, truck driver Randy Crume of Harrah, Okla., and the owner of the truck he drove, Tulsa.-based Refrigerated Delivery Services Inc.

Also sued is KKM Construction Inc., Texarkana, Ark., which has a contract with TxDOT to repair an interstate bridge south of Gainesville not far from the site of the wreck. The lawsuit claims that repair work “created a traffic jam that backed up for miles” prior to the wreck.

Investigators have said the wreck happened when the big rig came upon the slowed traffic and slammed into the SUV.”
